Actually, I think those villains were going to be in TLBM anyways. The daleks have a different design than in LEGO Dimensions.
I don't know about that, they wouldn't have the rights if they didn't get them for LEGO Dimensions.
I think LEGO got the rights to the daleks because of the LEGO Ideas set. They got the rights to everything else because Warner Brothers made the movie.

King Kong and Kraken weren't in Dimensions, unless you count the Story Pack that's directly based on TLBM.
All those characters were in there because either LEGO or Warner Bros. has the rights to them.
Just like how in TLM, there were characters like Gandalf, Green Lantern, Lloyd Garmadon, and Dumbledore.
