OOC: Well, he seems to have a mind, will, and emotions. He also has brain activity and a heart beat (I think ). That should count for life. And yes, he had been 'born' ten minutes earlier which is all the more reason to believe that he was somehow deemed worthy, seeing as how the beginning of the movie had made a big deal about no one in the Avengers being able to lift it, except for Cap'n 'Merica who came extremely close.
