The worst they can do is have us discontinue the use of their images, and also remove "lego" from the title/url, neither of which are a big deal, and both of which are unlikely. What they can't do is shut down the forum altogether, which would be the only real fear here.
But I think it's reasonable to assume that no one at LEGO wants this place shut down. The only reason the official boards are going offline is because of monetary concerns, and things of that nature.
THAT SAID
I would suggest that we have an easily-discoverable disclaimer that says, "LEGO(R) and its affiliates are registered trademarks of The LEGO Group, LLC." and all that jazz, just so it's clear we're not trying to come off as an official board. That's where we could run into trouble.

Technically, all content posted on the MBs belongs to LEGO.

On Talk to the Mods, someone asked: "if I wanted to publish one of my message board stories, would I be allowed to? I'd assume if I was I'd have to give LEGO some (or all. I'm happy to do that too) of the royalties made from each ebook sold."
WhiteAlligator replied: "Yes. Your content is still yours to publish. However we do recommend consulting an attorney before entering any publishing agreements."
I assume that means we can use our posts in other places.
