I swear the only way to not tie is if your opponent messes up
That's probably why they have time limits, so you rush and fluff it.

That's fair. But in something as simple of this, there are only a few scenarios that can arise.
After all up to isomorphism (rotating the board) there are only 3 different ways to start the game
