The gunman does stay focused on B. W. Dees character (whose name eludes me yet again), allowing one of the volunteers to make a dash to join Martin on the stairs.
At the top of the stairs are three doors. One of them is cracked a bit, the others are locked.
IC: *Martin looks through the crack. If the gunman is in there, he kicks down the door and yells.* "On the floor! Now!"
The gunman is in that room. He whips around to fire at Martin, but discovers he is out of ammunition. He stands there, frozen in indecision, as a pistol flies through the window and bounces off the back of his head. He turns around, befuddled, rubbing his head.
